Rental Terms and Conditions
1. Risks, Liability, and Insurance
Liability Insurance: The rental client must maintain a $1,000,000 liability insurance policy at their own expense and list Westlight Studios Franklin (WSF) as an additional insured.
Property Disclaimer: WSF is not responsible for any lost, stolen, or damaged property.
Assumption of Risk: The rental client assumes all risk and responsibility for any injury, death, or property damage resulting from their actions, the actions of their clients, guests, or any persons brought onto the property.
Indemnification: The rental client agrees to release, indemnify, and hold harmless WSF, its agents, employees, and owners from any claims, actions, liabilities, or damages arising from injuries, losses, damages, or death related to the rental, regardless of cause, including but not limited to negligence or breach of contract.
2. Fees & Payments
Payment Due Date: Full rental payment must be made before or on the start of the rental day.
Rental Application: The rental client must complete an online rental application and read all Terms, Conditions, and Requirements before booking.
Rental Periods:
Full-day rental: 10 hours
Half-day rental: 5 hours
Overtime Fee: $100 per hour for time used beyond the agreed rental period.
3. Payments & Cancellations
Payment Authorization: Payment information must be provided at the time of booking. The credit card on file will be charged on the day of the scheduled rental.
First Holds:
If another rental request is made for the same date, WSF will contact you to confirm your booking with full payment.
If you decline to confirm, your booking will be released without charge.
Second Holds:
You may request a second hold on a date that is already booked. If the date becomes available, WSF will contact you to confirm.
Cancellations:
Cancellations within 3 business days of the rental date will be charged the full quoted rental rate.
First Holds: Rental credits may be issued only if a Second Hold replaces the booking.
Cancellation Exceptions:
COVID-related cancellations: A positive COVID test result must be provided to qualify for a rental credit.
Special Circumstances: Rental credits for other cancellations are at the discretion of WSF management.
4. Noise Policy
No Guarantee of Silence: WSF cannot control external or environmental noise and does not guarantee a soundproof environment.
Use of Smoke and Fog Machines:
Smoke bombs of any kind are strictly prohibited. A $500 fine will be automatically charged for any use of smoke bombs.
Fog machines and hazers are permitted only when renting both studios (A & B) to prevent contamination of adjacent sets.
Music & Live Instruments:
Volume must be controlled if it disturbs other clients.
Live drums or loud instruments require rental of both studios to prevent disruptions.
5. Conduct & Studio Policies
Professional Behavior: Renters and their clients must conduct themselves professionally at all times.
Respect for Other Renters:
Do not enter other studio spaces without permission.
Disruptive behavior may result in rental termination.
Smoking Policy:
No smoking inside the building.
Designated smoking area: Right side of the building.
Location & Parking Rules:
The Factory is not an authorized filming location without written permission. Violations may result in a $450 location fine.
Do not park in unauthorized business areas. Vehicles may be towed at the owner's expense.
Cleaning Responsibilities:
The studio must be left in a clean condition following the Cleaning Policy Checkout List.
A $250 cleaning fee will be charged if these conditions are not met.
6. Cleaning Policy Checkout List
Return all photo equipment (stands, extension cords, lights, apple boxes, V-flats, light boxes, sandbags) to the designated equipment storage area.
Clear all countertops and tables of bottles, cups, trash, and wipe down all surfaces.
Sweep and clean floors in studios and client areas, including hallways, bathrooms, kitchen, dressing rooms, and makeup areas.
Return all cleaning supplies to the west hall cleaning supply closet.
Empty all trash cans and replace liners if contents are wet (bathrooms, kitchen, makeup rooms, and client areas).
Return all furniture to its original place.
Agreement
By renting WSF, I acknowledge and agree to comply with all cleaning policies. Failure to meet these requirements may result in a $75 cleaning fee and refusal of future rentals. A cleaning checklist must be completed and signed at the end of each rental.
7. Credit Card Authorization
I authorize Westlight Studios Franklin, TN to charge my credit card for:
The rental amount indicated on the Online Rental Application.
Any expendables, cancellation fees, damages, or additional equipment fees incurred during my rental.
A $10 pre-authorization charge before the rental date to verify card validity (this amount will be deducted from the final rental charge).
I agree to pay all charges per the credit card agreement, including any processing fees. This card remains on file for future cancellations or damages unless removed in writing.
8. Private Party Rentals
Overtime Fees: An additional fee of $100 per hour will be charged for rentals extending past midnight.
Cleaning Fee:
A $250 cleaning fee applies to private events where food and beverages are served.
Furniture Removal:
All rental furniture must be removed the same day or stored in WSF's designated storage area.
Alcohol Service:
Alcohol service requires additional liability insurance and must be handled by ABC-licensed servers.
9. Policy Changes
These Rental Terms & Conditions are subject to change at any time. Updates may be communicated via email or verbal agreement.
Final Agreement
By booking a rental at Westlight Studios Franklin, I acknowledge that I have read, understood, and agreed to these terms and conditions.
